05-23-03: Anderson seeks destruction of
arrest records |

Attorneys for Kimberly Anderson of Wapakoneta have filed a motion to
destroy all records relating to her arrest and indictment for the shooting death of her
estranged husband, Celina attorney Brent Anderson in Sept. 2001.
Kimberly Anderson, 38, was acquitted of aggravated murder, murder and
voluntary manslaughter during a trial in October 2002.
The motion for expungement of the arrest and court records was filed
Thursday in Auglaize County Common Pleas Court. As of this morning, court personnel were
not certain if the motion should have been filed in Auglaize County or Defiance County,
where the trial was moved due to publicity.
No date was given for a hearing on the motion filed by Anderson's
attorneys, Alan Konop and Nicole Khoury of Toledo.
The motion seeks to annul and destroy all records currently held by the
Auglaize County Sheriff's Department, the Wapakoneta Police Department, the Auglaize
County Prosecutor's Office, the Bureau of Criminal Investigation and Identification, the
Auglaize County Data Center and the Federal Bureau of Investigation (FBI).
Kimberly Anderson was indicted in December 2001 after she fatally shot
Brent Anderson, 37, multiple times in an upstairs bedroom the couple once shared. They
were separated at the time and a divorce was pending.
Kimberly Anderson stated in court that she acted in self defense. She
said she feared for her life that Labor Day weekend as her husband came after her during a
domestic dispute.
A civil suit filed by Brent Anderson's brother, Kevin Anderson of
Cincinnati, was dropped in March at the request of Brent Anderson's family. Pam Anderson,
Brent Anderson's sister, told The Daily Standard for an earlier story that the family
wished to concentrate their efforts on an ongoing custody suit involving Brent's children.
Kimberly Anderson has retained custody of the couple's two young sons,
Eric and Ryan, and was never incarcerated following the shooting. |
